What is a QDRO?
Qualified Domestic Relations Order (QDRO) is a court order which dictates how retirement benefits are divided and paid to respective spouses in a divorce. Because of strict filing requirements by federal law guidelines detailed by REA (Retirement Equity Act) and ERISA (Employee Retirement Income Security Act), state domestic relations law and differing plan requirements, and issues such as survivor benefits, cost of living, and early retirement, many attorneys find drafting a QDRO to be a difficult, time-consuming and frustrating process.
In addition, there are other court orders (MCO's, COAP's DRO's, etc.) for plans not subject to ERISA, such as military, federal civil service, state, local, and teachers’ orders, which can provide their own set of challenges.
